Workers’ Compensation insurance is required in California for all employers to provide to their employees. Injured workers are entitled to receive workers’ compensation benefits for an on-the-job injury, regardless of fault by the employee or employer. There are six (6) types of benefits available in California:
- Medical Care: Injured workers are entitled to receive all medical care reasonably required for the care and treatment of their injury at no cost to the employee.
- Temporary Disability: Injured workers who cannot return to work within three (3) days of the work related injury can receive benefits for partial lost wages as a result of their injury.
- Permanent Disability: Injured workers who are permanently disabled as a result of an injury sustained on the job can receive benefits for life.
- Vocational Rehabilitation: For injuries sustained before January 1, 2004, injured workers who ca2008_cnnot return to their former type of work can participate in a rehabilitation training program that will enable them to find gainful employment in another field.
- Supplemental Job Displacement: For injuries sustained after January 1, 2004, the injured employee can utilize a voucher for education-related retraining and skill enhancement. The maximum voucher amount is $10,000.
- Death Benefits: Should a worker be fatally injured, burial expenses are provided up to $5,000. The worker’s dependents may be eligible to receive support payments for a period of time.
